Celebrity Tattoo Artist Kat Von D Wins Copyright Lawsuit Over Miles Davis Tattoo
The recent legal battle between celebrity tattoo artist Kat Von D and photographer Jeffrey Sedlik has finally come to an end with a jury ruling in favor of Von D. The dispute arose when Sedlik claimed that Von D had used his portrait of jazz legend Miles Davis as the basis for a tattoo she created for a friend. However, after just over two hours of deliberation, the jury found that Von D did not violate Sedlik’s copyright and that her use of the image fell within the legal doctrine of fair use.
Von D, known for her work on reality shows like “Miami Ink” and “LA Ink,” expressed relief outside the courtroom, stating that the two-year legal battle had been a nightmare for her and her fellow tattoo artists. Her attorney, Allen B. Grodsky, also emphasized that the case should never have been brought to trial and that the jury’s decision was a victory for artists everywhere.
Sedlik’s attorney, Robert Edward Allen, has stated that they plan to appeal the decision, arguing that the images were substantially similar and that the jury’s ruling could set a dangerous precedent for artists. However, Von D maintains that her work was a form of fan art and that she never intended to profit from it.
Despite the legal victory, Von D has expressed reluctance to return to tattooing, stating that the ordeal has taken a toll on her. It remains to be seen how this case will impact the tattoo industry and the way artists approach their work in the future.
